The Maryland rules that apply either way
Waiting period. Maryland law prohibits cremation until at least 12 hours after death, and a cremation may not proceed without authorization from the Office of the Chief Medical Examiner, under Md. Code, Health-General §5-502.
Who authorises the disposition. An authorizing agent must sign the cremation authorization (COMAR 10.29.19.07). Under Md. Code, Health-General §§5-502 and 5-509 the priority runs from a person named by the decedent to the surviving spouse, then adult children, then parents, then adult siblings, with a 24-hour window for another class member to object.
Scattering. Maryland has no state law restricting where ashes may be kept or scattered, but cremated remains may not be scattered on public land or on another person's property without permission; water scattering follows the federal Clean Water Act (3 nautical miles offshore for the ocean).
Regulator. Maryland State Board of Morticians and Funeral Directors (with the Office of Cemetery Oversight).
Your rights under the FTC Funeral Rule
The FTC Funeral Rule, 16 C.F.R. Part 453, applies in Maryland as it does in every state. As documented by the FTC, it requires a funeral provider to give an itemised General Price List on request, to quote prices over the telephone, and to accept a casket or urn bought elsewhere without charging a handling fee. It also prohibits requiring a casket for a direct cremation.
