This subtraction crosses two different levels of geography: a state-level figure and a national one. It is arithmetic on published numbers, not a measurement of the gap inside Virginia. The Virginia rules that apply either way
Waiting period. Virginia does not impose a fixed statutory waiting period between death and cremation, but under Va. Code §54.1-2818.1 no body may be cremated without permission of the Office of the Chief Medical Examiner (as required by §32.1-309.3) and visual identification of the deceased. Board regulations (18VAC65-20-436) require a 24-hour wait when visual identification is not made.
Who authorises the disposition. A person named in a signed, notarized designation under Va. Code §54.1-2825 has first priority to authorize cremation and disposition, ahead of everyone else. Absent a designation, the next of kin authorize; if the next of kin disagree, any of them may petition the circuit court under Va. Code §54.1-2807.01.
Scattering. Virginia has no state statute restricting where cremated remains may be scattered — ashes are treated as personal property. Scattering on your own land is fine; on private land you do not own, get the owner's permission. Scattering at sea follows the federal Clean Water Act (at least 3 nautical miles offshore, notify the EPA within 30 days); inland waters may require a permit from the agency managing the waterway.

Your rights under the FTC Funeral Rule
The FTC Funeral Rule, 16 C.F.R. Part 453, applies in Virginia as it does in every state. As documented by the FTC, it requires a funeral provider to give an itemised General Price List on request, to quote prices over the telephone, and to accept a casket or urn bought elsewhere without charging a handling fee. It also prohibits requiring a casket for a direct cremation.
