West Virginia does not fix a single statewide hour-based waiting period, but crematories generally wait at least 24 hours after death and must have a disposition permit and the medical examiner's or coroner's authorization before cremating (see W.Va. Who authorises the disposition. Cremation must be authorized in writing by the person with the right to control disposition — typically the person named in a written appointment, then the surviving spouse, then a majority of adult children, then the parents, then siblings.
Scattering. West Virginia has no statute specifically restricting the scattering of ashes. Cremated remains may be scattered on private property with the owner's consent or on public land or waters consistent with local ordinances; scattering at sea follows federal EPA rules (at least 3 nautical miles from shore).
