The New Hampshire rules that apply either way
Waiting period. New Hampshire generally requires a 48-hour waiting period before cremation (with an exception for certain infectious-disease deaths) and a medical examiner's certificate, along with a signed cremation authorization form; see RSA ch. 325-A.
Who authorises the disposition. The right to authorize cremation and control disposition follows the custody-and-control order in RSA ch. 290, and a signed cremation authorization form is required under RSA ch. 325-A before a crematory may proceed.
Scattering. New Hampshire has no restrictive statewide scattering statute. Scattering on private land requires the owner's permission; scattering on public land or over water follows the land manager's rules and federal EPA guidance for waterways.

The FTC Funeral Rule, 16 C.F.R. Part 453, applies in New Hampshire as it does in every state.
